1. Introduction and Acceptance of Terms
- These Terms & Conditions govern the use of the Peaksy website and services, where Peaksy operates as a prepaid Print-on-Demand (POD) T-shirt store offering custom-designed apparel manufactured only after order confirmation, and by accessing or placing an order, users agree to be bound by these terms in full.
- Continued use of the website, including browsing, purchasing, or interacting with services, constitutes acceptance of all policies, including Privacy Policy, Shipping Policy, and any additional guidelines published on the platform.
2. Product and Service Details
- All products listed on Peaksy are made-to-order and are not pre-stocked, meaning production begins only after successful payment confirmation, which may result in longer delivery timelines compared to ready-made products.
- Product images are for representation purposes, and while efforts are made to ensure accuracy, slight variations in color, print placement, or fabric appearance may occur due to the custom production process.
- Peaksy reserves the right to modify, discontinue, or update product designs, pricing, and availability at any time without prior notice.
3. User Responsibilities
- Customers are responsible for providing accurate information, including correct size selection, shipping address, and contact details at the time of placing an order, and any errors provided by the user may lead to delivery issues or dissatisfaction for which Peaksy may not be held fully responsible.
- Customers must carefully review product details before placing an order, as all items are custom-produced and changes after order confirmation may not be possible.
- Misuse of the website, fraudulent activity, or providing false information may result in order cancellation and restriction of access to services.
4. Orders, Payments, and Pricing
- All orders on Peaksy are processed on a prepaid basis only, and payments must be completed through authorized payment methods supported by PhonePe Payment Gateway, including UPI, debit/credit cards, or wallets.
- Orders will not be processed until payment is successfully received and confirmed.
- Peaksy reserves the right to cancel or refuse any order in case of suspected fraud, payment issues, or operational limitations.
5. Order Cancellation
- Customers may request cancellation of an order within 24 hours of placing it, provided production has not already started.
- After 24 hours or once production has begun, cancellation requests will not be accepted due to the custom nature of the products.
- Approved cancellations will be processed according to internal procedures and timelines.
6. Replacement and Issue Resolution
- Peaksy offers replacement only in cases where the product received is damaged, defective, or incorrect, and customers must report such issues within 3 days of delivery.
- Customers are required to provide clear photo or video proof of the issue, and Peaksy reserves the right to evaluate and determine the validity of the claim before approving any replacement.
- Issues related to incorrect size selection, minor variations in design, or subjective dissatisfaction with the product will not be eligible for replacement.
7. Intellectual Property Rights
- All designs, content, logos, and materials available on the Peaksy website are either owned by Peaksy or used under appropriate permissions, and unauthorized reproduction, copying, or commercial use is strictly prohibited.
- Customers agree not to use, distribute, or replicate any designs from the website for commercial purposes without explicit permission.
8. Limitation of Liability
- Peaksy shall not be held liable for any indirect, incidental, or consequential damages arising from the use of its products or services, including delays caused by third-party logistics providers or manufacturing partners.
- In all cases, Peaksy’s liability shall be limited to the value of the product purchased.
- Peaksy is not responsible for delays or failures caused by events beyond its control, including natural disasters, courier disruptions, or unforeseen operational issues.
9. Dispute Resolution
- In case of any disputes or issues, customers are encouraged to first contact Peaksy support for resolution, and reasonable efforts will be made to resolve concerns in a fair and timely manner.
- Legal action, if required, shall be subject to the jurisdiction of courts located in West Bengal, India.
10. Changes to Terms
- Peaksy reserves the right to update or modify these Terms & Conditions at any time without prior notice, and continued use of the website after such changes constitutes acceptance of the revised terms.
- Users are advised to review these terms periodically to stay informed about updates.
